The contract is made when Design Your Caps USA, LLC accepts your order by giving notice to you. We will not accept your order until full payment is made, including the product price and applicable delivery charges.
1. PAYMENT METHODS
1.1 Any purchases may be paid for using a Paypal account or credit card through third party merchant facilities. Design Your Caps USA LLC is not responsible, nor has any control over any third-party merchant facilities. Customers acknowledge and agree that Design Your Caps USA LLC will not be liable for any loss or damage arising out of their use of a third-party payment gateway. Design Your Caps USA, LLC advises that Customers should read and understand the terms and conditions of the third-party merchant facilities before using them.
1.2 All prices on Design Your Caps USA, LLC are shown in United States Dollars (USD). Sales Tax, if applicable, will be charged and will be noted in the Price prior to Payment.
1.3 Customers acknowledge and agree that some banks and financial institutions may charge you an additional fee for international transactions, and that Design Your Caps USA LLC is not responsible for, nor has any control, over that fee being charged. Please check with your Credit Card Company in advance to determine if any such fees will be charged.
1.4 Customers acknowledge and agree that Item prices do not vary according to your location; however you accept that delivery charges will vary depending on the destination.
1.5 Customers Agrees that by presenting Credit Card Payment Information, they are not only authorizing Design Your Caps USA LLC to charge the Credit Card for the Product, but you also represent and warrant that you are authorized to use the Credit Card in question.
1.6 Customers acknowledge and agree that Design Your Caps USA LLC is not responsible for any additional charges, fees or taxes charged by local government, port authorities or 3rd party agencies. Any additional charges are the responsibility of the customer and not the responsibility of Design Your Caps USA LLC.
2. DELIVERY ARRANGEMENTS
2.1 Your shopping basket on the site displays the items you have chosen and details of postage and packaging. The delivery costs for each Item may vary according to the delivery methods available for that particular product.
2.2 Any delivery times quoted are in business days.
2.3 Delivery time is 3-4 weeks. Shipping costs are determined at the checkout.
2.4 Customers acknowledge and agree that the Items offered for sale are directed solely at residents in the United States. Design Your Caps USA, LLC makes no representation that any Items sold through the site are appropriate or available for use outside the United States. Customers must comply with all applicable laws and regulations of the country for which the items are destined. Please be advised that some items may not be deliverable overseas due to local law and it shall be your responsibility for any failure to deliver the Items overseas due to local law. We will not be liable for any breach by you of any laws.
3. SPECIAL OFFERS
All specials, promotions, clearances, offers, and discounted items advertised on the site are available only while stocks last unless otherwise stated.
4. ITEM AVAILABILITY
All Items offered for sale are subject to available stock. If a product is out of stock, Design Your Caps USA, LLC will contact you to offer a substitute product of at least equal quality. If you do not accept a substitute product and your credit card has been charged for a product that is out of stock, Design Your Caps USA, LLC will cancel your order and issue a credit to your credit card account in the amount charged.
5.1 If there is a defect with any of the Items in your order, you must notify us in writing via e-mail to email@example.com within 5 days of receipt of the Items of your intention to return the Items to us.
5.2 You must provide a copy of your invoice and receipt along with your notification.
5.3 You must provide the particulars as to why you are not satisfied with the Items in your order. You must include a clear photograph of the defect.
IMPORTANT ITEMS TO NOTE ABOUT OUR PRODUCTS
Please note that due to the Unique Nature of fabricating the items for sale, along with visual discrepancies that may appear in any particular monitor or screen, all parts of our products that are in color may have up to a 10% variance from the color seen on the screen, as well as between each batch of products, including any re-orders. Therefore this variance is not an acceptable reason for returning a product.
6.1 Due to the custom nature of each hat produced, Design Your Caps USA, LLC does not offer returns or refunds.
6.2 In the event that you have received is incorrect, a return can be approved at the discretion of Design Your Caps USA, LLC. In such case, you are responsible for returning of the Items to us within 30-days from date of receipt of the Merchandise period in order for the Items to be covered under this policy.
6.2 You are responsible for the postage and delivery costs of returning the Items to us and you cannot recoup such costs from Design Your Caps USA, LLC.
6.3 Design Your Caps USA, LLC is not responsible for replacing any items that have been lost in transit.
6.4 You must ensure that the items are returned to us unwashed, unused, and in their original packaging and tags intact. If the item does not comply with this paragraph, you will not be eligible for a replacement or return under this policy.
7. REPLACEMENTS ONLY
7.1 Upon receipt of the returned item, Design Your Caps USA, LLC will inspect the item and make its decision in its sole discretion on your notice whether it is more appropriate to offer a replacement.
7.2 Customers acknowledge and agree that due to the customized nature of the Items, Design Your Caps USA, LLC cannot offer any refunds. There is little to no resale value for the Items.
7.3 This Policy does not apply to any Items purchased on sale. No returns, refunds, or replacements will be available in such an event.
